TEACHER’S CONTRACT OF EMPLOYMENT

21st Century English School

1. CONTRACT

1.1 This is a contract of employment between

MRS MAY HSU

( Manager, 21st Century Language School)

(henceforth referred to as "The employer "), and

________________________________

(henceforth referred to as "The Teacher").

This contract is for a period of one year commencing ________ until ____________________ (inclusive).
 
 

1.2 Not less than two calendar months prior to the concluding date of this contract, The Teacher shall be advised whether he/she shall be offered a subsequent contract, and conditions pertaining thereto. This contract is construed under local employment law and shall take precedence over any other documents relating to the employment of the teacher unless said documents state otherwise. 2. DUTIES
    1. The Teacher contracts to undertake all duties assigned by The Employer. These duties shall generally include, but not be limited to, the following:
    2. Classroom teaching on the school premises, or other schools, where The Employer agrees to provide teachers. Teaching at locations other than schools, such as company offices, community halls, or private homes, as directed by The Employer.
    3. Being available at the school during all paid Non-Teaching Hours.
    4. Conducting regular telephone assessments of teaching effectiveness, where required, for all internal classes and provide material(s) for all external classes to enable those schools to conduct their own assessments.
    5. Providing neat, accurate written lesson plans for all classes and completing written follow-up lesson/class reports after all classes.
    6. At the start of each new month, teachers should firstly, be able to provide neat, accurate written details of monthly objectives for all classes and secondly, have completed monthly class and student reports.
    7. Assisting in the development of new courses, classes and syllabi in conjunction with fellow teachers, as requested by the school.
    8. Providing guidance to students on issues relating to study, exams and opportunities to study abroad.
    9. Ensuring workspaces and resource materials are kept neat and tidy.
    10. Directing/assisting the Front Office staff to correct student’s homework, reading and pronunciation as and when needed.
    11. Assisting in the recruitment of new students through teaching demonstration lessons and conducting placement testing where required.
    12. Attending, organising and participating in social events, meetings and other activities, as and where required by the school.
    13. Providing advice to fellow teachers on any issues relating to teaching E.F.L.
    14. Being able to fully and accurately account for work done during any Non-Teaching Hours.
3. HOURS OF WORK, SALARY & BONUS
    1. The Teacher agrees to be available to carry out his/her duties during a 10-hour day, between the hours of _______ to ________ or as advised by the Employer. Two hours per day are considered 'time off' and are unpaid.

    4. If, after consulting with the school, the teacher wishes to shorten the hours of availability, the hours can be reduced with a pro-rata decrease in pay (pro rata = 20000/30 days/8 hours = NT$667 a day, NT$83 an hour).
    5. The Teacher cannot refuse to accept any classes unless his/her current teaching load is greater than 6 hours per day.
    6. The Teacher agrees to an additional gross hourly rate of NT$________ for teaching scheduled classes within the above-mentioned hours.
    7. An additional NT$______ will be paid for each full teaching hour that falls outside The Teacher’s agreed working hours above.
    8. Management will undertake a review of The Teacher's hourly pay rates three months after this contract's inception date, followed by another six months later. A pay rise of at least NT30 per teaching hour will be considered, dependent upon The Teacher's general performance
    9. Teachers are paid 10 days after the end of each month worked (i.e. on the 10th of the following month).
    10. On completion of a one year contract, the equivalent cost of an economy class one-way ticket to North America (for Americans and Canadians) or London, U.K. (for other nationals) shall be awarded. This would be at least NT15 000.
4. CONDUCT
    1. The Teacher, when providing his/her own transportation, is expected to arrive at external class sites a minimum of 10 minutes prior to the commencement of the first lesson.
    2. In the event of The Teacher being late or unable to attend, he/she must notify the school as soon as possible in order to excuse the absence and so the appropriate course(s) of action may be taken.
    3. If The Teacher is sick, he/she must obtain the relevant documentation to support this i.e. medical certificate, etc. in order to excuse the absence.
    4. Unexcused absences will result in a fine not exceeding NT$3000.
    5. The Teacher agrees not to discuss any details of his/her remuneration package, student roles or any other information that may be regarded as commercially sensitive with persons other than full time employees 21ST CENTURY ENGLISH SCHOOL. Furthermore, The Teacher acknowledges that failure to strictly adhere to the above, will result in a fine of up to NT$100 000, immediate dismissal and the loss of all accumulated benefits. Legal and criminal proceedings may, where applicable under local Law, also be initiated.
    6. It is a condition of employment that The Teacher does not engage in any other teaching, language exchange or employment without the prior authorisation of the Manager. The engagement in such activities, without prior approval, may result in immediate dismissal and the loss of all accumulated benefits.
    7. Teachers shall not retain any school property, including books etc, when the term of their employment ends. Should they be found to have done so, the school reserves the right to pursue the matter. Legal and criminal proceedings may, where applicable under local Law, also be initiated.
5. VISA & REGISTRATION 5.1 Teachers should ensure that they are in possession of a 60-day visitor's visa for Taiwan before arrival. Should they only be granted a 30-day visitor's visa, then they are to inform the school of this fact before arrival.

5.2 The school shall support the application of The Teacher for a work visa. The Teacher shall be responsible for the submission of all relevant documentation (degree, 8 passport photos, passport, and health report) to the proper authorities and for all actions, including the payment of fees, necessary to maintain the validity of the visa.

5.3 The Employer shall only pay for the cost of the annual medical report provided that it is acceptable to the authorities and that the full duration of the contract is completed. The Teacher shall be liable for all other costs necessary to obtain and maintain the required visa(s).

5.4 To assist the working visa application process, all relevant documentation (degree, 8 passport photos, passport) in original form is to be submitted to the school within four days of arrival.

5.5 In the case of an external ‘visa trip’ being required (e.g. to Hong Kong), the school will cover 50% of costs incurred, provided The Teacher has satisfied all requirements listed (in 5.+) above. The remaining 50% will be paid at the end of the contract period. ‘Costs incurred’ include only economy airfare and hotel costs.

6. WELFARE & BENEFITS 6.1 It is a condition of residence in Taiwan that all residents become members of the National Insurance Scheme. A monthly deduction of between NT1000 and NT1500 will be made at source from The Teachers’ salary to cover monthly fees. 7. HOLIDAYS AND LEAVE 7.1 Staff holidays should follow the school calendar. This generally means about 5 days off at Chinese New Year in February and another 5 days off during the August summer holiday. Additional leave may be granted at the discretion of the Employer.
    1. If teachers require additional leave for any reason, the school should be notified 24 hours in advance. The teacher will be liable for a reduction in salary for every full day absent. This reduction is on a pro-rata basis and totals NT$667 per day. Approved hours absent render the teacher liable for a reduction of NT$83 per hour absent.

    3. Unapproved absences shall render the teacher liable for a pro-rata x 3 salary deduction, totalling NT$2001 per full day absent. Should a teacher be absent for an hour without approval, the reduction per hour absent is NT$249 .
8. RESIGNATION & TERMINATION OF CONTRACT
    1. In the event The Teacher wishes to resign prior to the completion of the contract period, a formal letter of provisional resignation shall be submitted to The Employer not less than two months before his/her intended last day of work.
    2. Once such provisional notice is received, Management undertakes to discuss the issue with The Teacher within three working days of receipt. Management reserves the right to negotiate the adjustment of this date by up to two weeks. Once this is finalised, Management will provide The Teacher with a letter confirming the agreed-upon date of departure.
    3. The airfare will be forfeit and the authorities will be notified once the teacher ceases to be an employee.
    4. Should a teacher leave without giving proper notice to Management, the school reserves the right to contact the Department Of Education and make it impossible to be legally re-employed in Taiwan. In addition, all tax owed to the former teacher by the Tax Department will be forfeit.
    5. Should The Teacher leave without giving advance notice, it is understood that he/she is liable for a punitive fine calculated at NT5000 for every different class The Teacher was responsible for. The Teacher is aware of, and agrees to, the fact that Management may take legal action to recover this amount.
    6. The Employer may at its discretion terminate this contract prior to the end of the contract period with a minimum of one month’s notice
    7. In the event of an act of gross misconduct being committed by the teacher, The Employer may, at its discretion, summarily dismiss the teacher without notice. Under such circumstances, no bonus payment or part thereof shall be payable to the teacher. Legal and criminal proceedings may, where applicable under local Law, also be initiated.
    8. The Teacher agrees that, in the event of his/her leaving the employment of the school, he/she shall not pass on any information relating to the school, or its operations, to which he/she may have become privy to during his/her employment. The Teacher further agrees that whilst in the employment of, or in the event of his/her leaving the employment of the school he/she shall neither defame nor make public statements of a damaging nature concerning the school or its associated companies or personnel. Furthermore, The Teacher acknowledges that failure to strictly adhere to the above, will result in a fine of up to NT$100 000 and the loss of all accumulated benefits. Legal and criminal proceedings may, where applicable under local Law, also be initiated.
    9. In the event of his/her leaving, the teacher shall return all books and materials given to him/her by The Employer. Any materials not returned will be charged to The Teacher.
    10. The Teacher agrees that he or she will not accept employment within the Miaoli County area once his or her term of employment 21ST CENTURY ENGLISH SCHOOL ends. In addition, The Teacher will not be permitted to accept employment from any school for which 21ST CENTURY ENGLISH SCHOOL has provided services.
    11. Should these conditions be violated, the Employer reserves the right to take further action. The Teacher acknowledges that failure to strictly adhere to the above, will result in a fine of up to NT$100’000 and the loss of all accumulated benefits. Legal and criminal proceedings may, where applicable under local Law, also be initiated.
